Terms and Conditions

These Terms & Conditions govern all removal and house clearance services provided by Berrington's Clearance & Removals ("the Company", "we", "our" or "us"). By accepting our quotation or instructing us to carry out work, you agree to these Terms.

1. Definitions

Customer means the person or organisation instructing us to carry out the Services.

Goods means all furniture, possessions, equipment and other items we are instructed to move or clear.

Services means domestic removals, commercial removals, house clearances and any other services agreed in writing.

2. Quotations

2.1 All quotations remain valid for 30 days unless otherwise stated.

2.2 Quotations are based entirely upon the information provided by the Customer.

2.3 We reserve the right to revise our quotation where:

  • additional items are presented on the day;
  • access differs from that originally described;
  • waiting time is incurred;
  • additional labour or vehicles are required;
  • parking restrictions prevent normal loading;
  • the scope of work changes.

2.4 Any additional work requested during the service will be charged separately.

3. Bookings

3.1 Bookings are confirmed once accepted by us and any required deposit has been paid.

3.2 We reserve the right to amend booking times where circumstances outside our control require us to do so.

4. Payment

4.1 Unless otherwise agreed, payment is due immediately upon completion of the Services.

4.2 Deposits are non-refundable unless we cancel the booking.

4.3 Outstanding balances may incur statutory interest and reasonable recovery costs.

4.4 Title to any goods removed for disposal transfers only where payment has been received in full.

5. Cancellation

5. Cancellation

  • More than 7 days before the booking – no cancellation charge.
  • Between 3 and 7 days – up to 25% of the agreed price.
  • Within 48 hours – up to 50%.
  • On the scheduled day – up to 100%.

We may waive cancellation charges at our discretion.

6. Customer Responsibilities

The Customer agrees to:

  • provide accurate information regarding the work;
  • ensure suitable access to all areas;
  • arrange parking permits or suspensions where required;
  • ensure an authorised person is present unless otherwise agreed;
  • disconnect appliances unless specifically included within our quotation;
  • remove all cash, jewellery, passports, legal documents, sentimental items and other valuables before work begins;
  • advise us of any item requiring specialist handling.

7. Items We Will Not Transport

Unless previously agreed in writing, we will not transport or remove:

  • firearms or ammunition;
  • explosives;
  • gas cylinders;
  • petrol, diesel or fuels;
  • hazardous chemicals;
  • asbestos;
  • clinical or biological waste;
  • illegal substances;
  • live animals.

Should any prohibited items be discovered, we reserve the right to suspend work immediately.

8. Access

If access is unsafe or unsuitable due to:

  • dangerous stairs;
  • structural defects;
  • flooding;
  • unsafe flooring;
  • severe weather;
  • blocked access;

we reserve the right to postpone or suspend the work until safe access is available.

Additional charges may apply.

9. Additional Charges

Additional charges may apply where:

  • additional items are added;
  • waiting time exceeds 30 minutes;
  • additional labour is required;
  • specialist lifting equipment is needed;
  • parking restrictions delay the work;
  • collection or delivery addresses change after booking.

10. Delays

Whilst every effort will be made to attend at the agreed time, delays caused by traffic, accidents, vehicle breakdowns, adverse weather or other circumstances beyond our reasonable control shall not constitute a breach of contract.

11. Our Liability

11.1 We will exercise reasonable skill, care and diligence when carrying out the Services.

11.2 Where loss of or damage to your goods is caused directly by our negligence or breach of contract, our liability shall be limited to £1,000 for any individual item, subject to an overall maximum liability of £50,000 for any single removal or house clearance, unless a different level of liability has been agreed in writing before work commences.

11.3 Our liability applies only where we are legally responsible for the loss or damage and is subject to the terms, conditions and exclusions of our Goods in Transit insurance policy.

11.4 We strongly recommend customers arrange additional insurance for any items exceeding our standard liability limits or which are of exceptional financial or sentimental value.

11.5 Nothing within these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or any liability which cannot legally be excluded.

12. Fine Art, Antiques & High-Value Items

12.1 We regularly transport paintings, sculptures, antiques, mirrors and other delicate items using appropriate care and protective materials.

12.2 Customers must notify us before the move if any individual item has a replacement value exceeding £1,000 or requires specialist handling.

12.3 Unless otherwise agreed in writing, all fine art, antiques and high-value possessions remain subject to our standard liability limit of £1,000 per individual item.

12.4 Where an item exceeds this value, we strongly recommend the Customer arranges appropriate transit insurance. We may, where requested, assist in arranging additional cover through a third-party insurance provider, subject to availability and acceptance.

12.5 We reserve the right to decline transporting exceptionally valuable or irreplaceable items where specialist handling, packing or insurance is considered necessary.

13. Damage to Property

If we accidentally damage your property through our negligence, we will repair the damage or provide reasonable compensation.

Damage should be reported before our team leaves wherever reasonably possible, or otherwise within 48 hours in writing.

14. Claims

Any claim for loss or damage must:

  • be submitted in writing;
  • include photographs where possible;
  • include a description of the damage;
  • be received within seven days of completion.

15. Force Majeure

We shall not be liable for delays or failure to perform caused by events beyond our reasonable control including:

  • severe weather;
  • flooding;
  • fire;
  • industrial action;
  • road closures;
  • vehicle breakdowns;
  • government restrictions;
  • Acts of God.

16. Subcontractors

We reserve the right to use carefully selected subcontractors where necessary.

Where subcontractors are used, these Terms remain applicable.

17. House Clearance Services

Authority

By instructing us, you confirm that you own the goods to be cleared or have full legal authority from the owner, executor or administrator to authorise their removal.

Scope of Work

Our quotation only includes the areas specifically identified during the survey or quotation.

Additional rooms, lofts, garages, sheds, gardens or outbuildings may incur additional charges.

Valuables

Customers are responsible for removing:

  • cash;
  • jewellery;
  • watches;
  • passports;
  • legal documents;
  • family photographs;
  • sentimental items;
  • medications;
  • mobile phones;
  • laptops and tablets.

We cannot accept responsibility for valuable items left amongst goods intended for clearance.

Hazardous Materials

We will not remove:

  • asbestos;
  • chemicals;
  • fuel tanks;
  • gas cylinders;
  • needles;
  • medical waste;
  • biological waste;
  • dangerous substances.

Should hazardous materials be discovered, work may stop until appropriate arrangements have been made.

Electrical Appliances

Unless agreed otherwise, appliances should be disconnected before our arrival.

Fridges and freezers should be emptied and defrosted.

Lofts, Cellars & Outbuildings

We will only clear these areas where safe access is available.

We reserve the right to refuse entry where access presents a health and safety risk.

Waste Disposal

We are committed to responsible waste management.

Where practicable, suitable items may be:

  • donated;
  • reused;
  • recycled;

before disposal through licensed waste facilities.

Waste Carrier Registration

Berrington's Clearance & Removals operates in accordance with all applicable UK waste legislation and maintains the necessary Waste Carrier Registration for the services we provide.

Unexpected Additional Waste

Where substantially more waste is present than originally quoted, we reserve the right to revise our quotation before continuing.

Keys & Access

Customers must ensure suitable access to the property.

Failed attendance caused by lack of access may incur a call-out charge.

18. Complaints

Should you be dissatisfied with our Services, please contact us in writing within seven days.

We aim to acknowledge complaints within five working days and resolve them promptly and fairly.

19. Governing Law

These Terms & Conditions are governed by the laws of England and Wales.

Any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales.
